Community Communication Subscription Terms and Conditions

These Terms and Conditions (“Terms”) govern participation in the communication tools provided by the [Homeowners Association / Condominium Association / Community Development District] (collectively, the “Association”). By registering as a user or submitting your contact information, you acknowledge and agree to the following:


1. Purpose of Communications

The Association may use digital communication tools to improve outreach to residents, members, or property owners. Communications may include, but are not limited to:

  • Newsletters and community updates
  • Event notices and reminders
  • Emergency alerts or urgent notifications
  • General announcements about Association operations

Note: These communications are informational only and do not replace official notices or documents required by law or by the Association’s governing documents (such as meeting notices, budgets, assessments, or compliance matters).


2. Consent to Receive Communications

By providing your contact information, you grant the Association and its authorized agents permission to contact you through one or more of the following methods:

  • Email at the address you provide
  • Text/SMS messages at the phone number you provide (standard carrier rates may apply)
  • Phone calls at the phone number you provide
  • Push or IP-based notifications on digital devices where enabled

This consent remains valid until you revoke it in writing.


3. Voluntary Participation and Opt-Out

Providing your contact information is voluntary. You may unsubscribe from email lists or request removal from SMS/phone contact lists at any time by following the opt-out instructions in a communication or by contacting the Association’s management office.


4. Public Records Disclosure (Florida-Specific)

If the Association is located in Florida, you understand that under Florida Statutes, including Chapters 119, 190, 718, and 720, email addresses, phone numbers, and other personal information provided to the Association may be considered part of the Association’s official records and subject to disclosure under Florida’s public records laws.


5. User Responsibilities

As a participant in the Association’s communication program, you agree to:

  • Provide accurate and current contact information.
  • Notify the Association of changes to your email address or phone number.
  • Use the website and communication tools only for personal, non-commercial purposes related to your membership or ownership in the community.

6. Limitation of Liability

The Association makes reasonable efforts to deliver accurate and timely information, but does not guarantee delivery or accuracy of all communications. The Association shall not be liable for:

  • Delays, failures, or errors in message delivery.
  • Any charges incurred through your mobile carrier for SMS or data usage.
  • Any consequences of relying on informal communications instead of official documents.

7. Acceptance of Terms

By submitting your contact information or using the Association’s website, you confirm that you have read, understood, and agree to these Community Communication Subscription Terms and Conditions.
